The Korea Fair Trade Commission (the “KFTC”) launched an investigation against Hyundai Construction Equipment (“Hyundai”), alleging that Hyundai interfered with Potenit’s business activities by using a program jointly developed by Hyundai and Potenit without Potenit’s consent. Lee & Ko represented Hyundai and argued that Hyundai had the right to use the program since the program is jointly owned by Hyundai and Potenit under the joint technology development agreement and Hyundai’s contribution in developing the program was significant. Lee & Ko successfully argued on behalf of Hyundai which was able to obtain a non-guilty verdict from the KFTC.
