In relation to a construction of an apartment in Ilsan, Goyang City, the Korean government, by securing a special administrative tax claim against the developer, sought cancellation of a trust agreement between the developer and the trust company claiming that such agreement is a fraudulent transfer. Lee and Ko’s Trust Practice Group represented the creditors of the above project, participating as a supplementary intervenor, and obtained a judgment that said trust is not a fraudulent trust from the court of first instance. The court of first instance held that the trust is not a fraudulent trust because it was established to complete the construction of the apartment which was the best option for the developer. Currently, Lee and Ko is representing both the trust company and the creditors in an appeal.
