In August of 2011, Lone Star Fund filed a lawsuit against the former KR&C for enforcement of an ICC award in Korea (award amount approximately USD 33 million). Lee & Ko represented the former KR&C and won both at the court of first instance and appellate levels, presenting an argument that, although it’s an ICC award, if the award disturbs public orders or good morals, it cannot be enforced (2012na88930 Seoul High Court, August 16, 2013). This will be a seminal case in conflict of laws.
