May 10, 2021. Maeil Business reports on Lee & Ko’s recent victory in the trademark dispute between “아임닭” (Ah-Eem-Dak) and “허닭” (Huh-Dak).
As Lee & Ko’s attorney Vera Eun Woo Lee explains, “this decision means that where a mark becomes well known to consumers through consistent marketing -- even for a period as short as one to two years -- a later, similar mark that causes consumer confusion should be cancelled.” She further states, “the court appears to have reached its decision based on the factual circumstances of the dispute and the business objectives of both parties.”
