Credit Information

In the financial sector, high-quality data is readily available, making its utilization highly valuable. As the era of artificial intelligence advances, the importance of utilizing financial data, including credit information, is becoming increasingly significant.

The amended Credit Information Use and Protection Act (“Credit Information Act”), which took effect on August 5, 2020, introduced several measures to foster the financial data industry, including the introduction of the MyData business, the advancement of regulatory frameworks for credit information businesses, the establishment of the right to request the transfer of personal credit information, and the regulation of procedures for data combination.

At the same time, to prevent misuse or leakage of data resulting from the growth of the data industry, enforcement under the Credit Information Act has also been strengthened—allowing, for instance, the imposition of administrative fines of up to 3% of a company’s total sales in the event of a violation. Furthermore, with the 2023 amendment to the Personal Information Protection Act, the right to data portability has been extended to non-financial sectors, and data subjects’ rights regarding automated decision-making using AI have been explicitly established. As the legal framework for credit information and personal information increasingly converge—while still retaining distinctions—legal advisory on the Credit Information Act has become a specialized field that requires an integrated understanding of both the Personal Information Protection Act and financial regulations.
