Lee & Ko’s tax team represented the taxpayer in relation to a case regarding the reduction of capital gains tax on newly constructed household apartments. Although the taxpayer had lost on both the trial and the appellate court when engaged, Lee & Ko nevertheless successfully reversed the decision at the Supreme Court and led to our client’s victory on all issues. This case was significant since a non-reversal by the Supreme Court would have had a major tax impact for tens of thousands of transferors of newly constructed household apartments that have transferred their property since 2009. However, upon our team’s thorough understanding of the issues and convincing argument before the court, we were able to reverse the holdings of the lower and high courts.
