Litigation involving the termination of an injured employee while working for a supplier of semiconductors

This case involved the issues of whether the termination of an employee who was on medical leave for treating a work-related injury or disease violated Article 23(2) of the Labor Standards Act.  Lee & Ko dissected the applicable statutory provision and various case precedents to emphasize to the court that the protective measures under Article 23(2) apply to those employee who actually require the leave period for treatment and does not apply to those who take the leave as a matter of formality.  The court agreed with our interpretation and ruled in the client’s favor.
