This case was the first of its kind dealing with the issue of an alleged failure to provide adequate protection for employees in high stress positions (e.g., operators handling customer grievances and complaints). Specifically, an employee who worked in the company’s customer services center was diagnosed with depression and even attempted to commit suicide due to stress he claims to have suffered from having to address customer complaints. This employee further alleged that the employer failed to provide adequate protective measures for employees in high stress positions. Being a matter of first impression, the court held for the employee at the district court level. However, on appeal to the High Court, Lee & Ko successfully demonstrated that the employer’s protective measures were sufficient and in accordance with the applicable laws and terms of the employee’s employment contract. As a result, the High Court reversed the lower court’s decision and held in favor of our client.
