The issue of this case was whether, in a spin-off, employees being transferred to a new company have the right to reject succession. Lee & Ko represented Hyundai Green Food from December of 2009, and after four years of litigation, Lee & Ko won the case on December 12, 2013 (2011du4282 Supreme Court). Prior to this case, the courts were not consistent in decisions regarding succession of employment relationships following an exercise of an employee’s right to consent or reject when a company has spun-off. However, as a result of the above Supreme Court decision, the legal standard for said issue has finally been established.
